The elements of a premises liability case include whether the owner had actual or constructive knowledge of some condition on the premises, the condition posed an unreasonable risk; the owner did not exercise reasonable care to reduce or eliminate the risk of harm and the owner's failure to use care caused injury.

There are two types of negligence which may result for failure to keep a safe premises

Negligence from an activity on the premises
Negligence from a defect on the premises.
